Insurance, and recourse.

Anyone practising on their own must be insured. The policy covers claims that arrive while it is in force, including for events ten years earlier: the documents from those treatments must still be retrievable.

The facts
Asymmetry after a breast augmentation. The surgeon does not enter an appearance. The patient brings her insurer into the case. At first instance the court orders the surgeon and the insurer to pay € 64,223, and the insurer a further € 40,290 for resisting without grounds and failing to produce the policy.
What was decided
The Court of Cassation allows the patient's appeal and remits the case to the court of appeal. It rules only on a procedural point, about bringing the insurer into the case. The sums are those of the first instance.

What protects the physician

  • A policy with the minimum requirements of the decree, with ten years of retroactive cover and ten of run-off cover.
  • A register of compensation claims with the date they arrive: the thirty days start from there.
  • Medical records and consents retrievable for the whole period the policy covers.
